The Wisconsin Department of Workforce Development issued a press release late Tuesday informing contractors that the state’s prevailing wage law is still in effect.
The announcement followed a report by the Associated Builders & Contractors of Wisconsin Inc., which has filed an injunction in Dane County Circuit Court against the law. ABC said Tuesday that DWD had agreed to temporarily suspend the Feb. 7 deadline for the first batch of payroll reports.
But Howard Bernstein, DWD’s legal counsel, said in the press release that DWD does not have the authority to suspend requirements and contractors are expected to comply.
The reports ask contractors to provide information in 50 fields, including Social Security numbers, straight and overtime hours for each day, weekly wage and hour totals, union status and union affiliation.
A hearing on ABC’s injunction is scheduled for Wednesday afternoon, and a circuit court judge may decide whether the Feb. 7 deadline should be suspended.
