MILWAUKEE (AP) — Federal prosecutors have charged the former president and co-owner of Schlomann Brothers Construction Inc. in Appleton with failing to pay federal taxes.

The Journal Sentinel reports that Roger Schlomann has been charged with two counts of failing to account for and pay to the IRS $900,000 in payroll taxes withheld from his employees.

Schlomann has agreed to plead guilty to both charges, each of which carries a maximum penalty of up to five years in prison and a fine of up to $250,000.

Prosecutor say he’s scheduled to appear in federal court in Milwaukee on May 13. According to the plea agreement filed in the case, Schlomann failed to file quarterly payroll tax returns between 1998 and 2007.
