A settlement has been reached between J.H. Findorff & Son Inc., Madison, and the families affected by the June 24, 2010, incident in which a concrete panel fell off the O’Donnell Park parking garage and killed 15-year-old Jared Kellner and injured two others.
The Madison contractor, along with Regent Insurance Co., settled July 31 following a “lengthy mediation” with the estate of Jared Kellner; his parents, Dawn and Christopher Kellner; and Steven, Amy and Eric Wosinski, according to a letter sent Aug. 14 to Milwaukee County Circuit Judge Christopher Foley by Donald Piper, attorney to J.H. Findorff & Son.
Amy and Eric Wosinski were injured when the 13-½ foot panel fell from the facade of the garage.
The Kellner and Wosinksi families, of Greenfield and East Troy, respectively, filed lawsuits against several involved parties in 2011 and 2012. Many of those parties have since been dismissed, though subcontractor Advance Cast Stone Co., which designed and installed the garage’s panels, and Milwaukee County remain.
Allan Foeckler and Timothy Andringa, the attorneys representing the Kellners and Wosinski’s, respectively, refused to discuss the terms of the settlement, saying it was confidential.
Piper did not return a phone call Wednesday afternoon.
The consolidated lawsuits are set to go to trial in October. It is scheduled to last about six weeks.
“The focus now is holding Advance Cast Stone responsible for Jared Kellner’s death,” Foeckler said.
The parking garage was closed for more than a year after the incident. It reopened after $5.4 million in renovations.
