MADISON, Wis. (AP) — A state appeals court has refused to order a judicial review of a state Department of Natural Resources’ decision to issue Enbridge Energy an air pollution permit.
The DNR granted the permit in June 2014 to cover construction of new tanks and piping at the company’s Superior terminal. Peter Bormuth of Jackson, Mich., asked the DNR for a hearing on the decision. The DNR denied Bormuth’s request in late July 2014.
Bormuth had 30 days to petition a judge to review the denial. He filed the request about two weeks after the deadline.
Bormuth argued he made a mistake because he was representing himself in the matter. The 3rd District Court of Appeals ruled Thursday that his petition was untimely.
